Building and construction activities must comply with the conditions applied to the Building or Planning approval – these conditions can relate to the management of noise, dust, and litter on the site.

Council compliance officers can use Local Nuisance and Litter Control Act 2016 to require measures to be taken to minimise the nuisance arising from noisy/dusty and ‘messy’ construction sites. Refer to Council’s compliance officer on 8584 8000.

I need to do some construction work out of house. Do I need any approval for this?

Yes. If you are intending on undertaking an activity that will or is likely to cause a nuisance in the form of noise, dust, or odour, you will need to apply for an exemption from the provisions of the Local Nuisance and Litter Control Act 2016.
